Shipping Terms and Conditions
The following Terms and Conditions have been created for customers of Kellie Miller Arts online shop only. They may, therefore, differ to those affecting customers making purchases through direct enquiry or in-store.
The term 'we' refers to Kellie Miller Arts, owner of the website and e-commerce shop, whose registered address is 20 Market Street, Brighton, East Sussex, BN1 1HH. The term 'you' or 'customers' refers to the customers placing orders through the Kellie Miller Arts gallery online shop.
Online Purchases
We have established an online gallery shop to facilitate sales of works of art, including prints, handmade ceramics, sculpture and glass.
We reserve the right to change or review the listed artworks and prices on our site anytime. Changes made will not affect any order already placed (unless otherwise outlined under Cancellation of Sales).
Please note that the price of the artwork listed does not include full delivery charges. Shipping cost will be advised upon checkout, prior to final payment.
Customers are welcome to pay for their goods online using a credit card or PayPal account only at this time. We do not apply additional fees for the use of this service, but cannot guarantee that your payment provider will not do so.
Prices listed are in GBP (£) only, and international customers should be aware that conversion fees may apply. Please refer to your bank or payment provider for confirmation of rates.
Cancellation of Sales
Our site is manually managed by a small team who do their best to ensure that all the information listed (price, artwork detail, availability, etc) is correct. In the instance that human or system error leads to any listed artwork being incorrectly advertised for sale (i.e. it is now out of stock, has been inaccurately documented, or priced), we will email you immediately to inform you of the error. We will not process your order until we have your instructions. Should we not be able to reach you for confirmation within 72 hours, your order will be automatically cancelled.
Customers have a right to cancel their order prior to dispatch and up to 14 days after receipt of their artwork. To do this, you will need to contact us immediately by email at gallery@kelliemillerarts.com. Cancellations made post-dispatch will be subject to the conditions of Returns, as explained below.
Shipping
At this time, we use DPD services for shipping online sales to mainland UK areas, and select trusted couriers for international shipments. Artworks are professionally hand-package and seal all products to ensure that they are safe for transport. We use the fastest services available to us through these suppliers and operate with tracking numbers for additional security. Although we do our best, we are a small business, so dispatch and shipping times cannot be guaranteed.
We are not liable for any additional costs incurred when shipping to addresses based outside of the UK. Please refer to your local government website for information on customs and import taxes.
We reserve our right to amend the price of shipping at the point of sale at any time and without prior notice.
Insurance
As outlined in DPD’s terms and conditions of service, goods (unframed limited edition prints and original 2D works) are covered up to £1,000 (subject to the courier’s processes for claiming compensation).
As with all primary courier services, DPD's insurance does not cover the transport of ceramics or glass, which means we cannot offer customers coverage on artworks of this description. It is, therefore, at your own risk to order these items from the online gallery shop for delivery.
It is advised that customers consider extending their home insurance policy to include any new artwork on the day of purchase, ahead of dispatch. Please refer to your home contents insurer or policy terms and conditions for guidance.
Missing or Damaged Goods
In the event that packaging is obviously damaged upon arrival customers should refuse delivery at which point the product will be returned to us for appraisal.
According to DPD’s Standard Terms & Conditions of Carriage, compensation for damages must be claimed within 14 days of dispatch. Therefore, notice of damaged artwork delivered to the buyer will need to be reported immediately to us in writing, by emailing gallery@kelliemillerarts.com. Photographic evidence of damages will be required to help us to submit a claim for insurance where possible, so it is advised that you photograph the package prior to handing it to the courier for return. Please send any images to us as quickly as possible.
We cannot be held liable for damages or losses as a result of shipping, and in the case of damaged or missing items in excess of £1,000, or for artworks not covered under DPD’s policy, or for claims made outside of the specified terms as outlined by the courier or by us (as above), we cannot assist in the recovery of losses.
Returns
You have the right to return an item within 14 days of delivery receipt. To begin the process, you must email gallery@kelliemillerarts.com, stating your order number, title of artwork and artist. A member of the team will aim to contact you within 48 hours. Once we have confirmed your return, you will have 14 days to send the item back to us as instructed.
It is the responsibility of customers to bear the costs of returning the item to us (including insurance where advised) and to make sure the artwork is safely packaged for transport.
All returned items must be received undamaged and in their original packaging. Upon receipt of your returned artwork, we have 14 days to issue you with a refund. Refunds will be less any fees incurred through payment providers.
Personal Data
Under the terms of the UK's Data Protection Act 2018 and the EU's General Data Protection Regulation (GDPR), customers have a right to know how and why their data is being used and stored by us.
All customers are required to enter their email address and home address during the checking out process (telephone number is optional but recommended). We also offer you the chance to join our newsletter mailing list at this point, although you may uncheck this box if you would prefer not to be contacted for this purpose.
The information gathered through our checkout system will be used for the sole purpose of maintaining contact for the safe delivery of your purchases.
We store your information in our system for the purpose of artwork sale processing, which is essential for our insurance and the secondary art market. Unless you give us permission to do so, we will not use this information to send you promotional emails or for any other contact outside of the order processing, delivery, or refunds / claims (where necessary).
Customers who sign up to join our mailing list will be sent monthly newsletters or personalised catalogues that may be of interest to them based on their previous purchases. Customers have the option to unsubscribe from our list whenever they choose, using the link provided in our emails.
